Страхова відмовилась виплачувати за дтп

Recently, our team was asked a question: “Вітаю. Я втрапив в дтп, я перевищив швидкість і вїхав в зад авто. Поліс покривав цей випадок, я не був п‘яний і так далі. Але страхова зараз відмовляється робити відшкодування. Як зі страхової отримати своє відшкодування за дтп?”

25.03.2021 20:01:16 Доброго дня. Зазвичай страхові компанії не виплачують потерпілій стороні грошові кошти, доки не буде винесено рішення судом, який розглядає матеріали щодо притягнення винуватця дорожньо-транспортної пригоди до адміністративної відповідальності. Після набрання законної сили рішення суду, яким встановлено винуватця ДТП подається до страхової компанії і тоді у страхової є 90 днів на виплату відшкодування. Звісно підставою відмови може буди не лише перебування винуватця у стані сп’яніння, можливо що винуватець не повідомив наприклад свою страхову компанію про страховий випадок (ДТП) протягом 3 робочих днів з моменту пригоди. Також буває, що відсутній попередній розрахунок заподіяної шкоди - калькуляції страхової або висновку експерта. Відмова у відшкодуванні моде бути оскаржена потерпілим до суду. У вас, як винуватця ДТП є обов’язок відшкодувати те що не було відшкодовано страховою, наприклад якщо розрахунок шкоди не покрив фактичного ремонту або ж упущена вигода і таке інше.
29.03.2021 16:19:03 1.Отримайте письмову відмову від страхової у виплаті відшкодування. Для цього направте до страхової письмову вимогу про виплату відшкодування (відповідь на вимогу ви отримаєте через 30 днів). 2.Підготуйте документи: договір зі страховою компанією, протокол поліції та схему ДТП, медичний висновок, що ви не перебували в стані алкогольного сп'яніння (якщо такий висновок був складений). 3.Після отримання письмової відмови від страхової звертайтесь до адвоката. Самотужки позов про стягнення страхового відшкодування правильно ви не напишете. 4.Ваш позов буде майновим, тобто за подання його до суду ви сплатите 1% від розміру відшкодування. 5.Позов подається до суду за місцезнаходженням страхової компанії (адресу страхової компанії ви знайдете в Єдиному державному реєстрі юридичних осіб, фізичних осіб-підприємців та громадських формувань).
