Recently, our team was asked a question: “Постановление №399 1.04.2022 гласит,что Студенты украинских вузов не могут пересекать границу Украины.
В связи с этим, студенты массово подают документы в иностранные вузы на программы Regular Students ,Exchange students или Free listener (Free Mover) -свободные слушатели.
Вопрос-законно ли это и не будет ли для таких студентов никакого рода последствий если,например,отчислиться сразу после пересечения границы?
На каком основании или при каких условиях страна может вернуть этих студентов назад?”

02.05.2022 14:42:33 Все вірно, до Постанови КМУ 399 01.04.2022р внесено зміни, які визначають деякі питання щодо перетинання кордону в період дії на території України надзвичайного або воєнного стану. Так, обмеження у праві перетину кордону не застосовуються до військовозобов’язаних віком від 18 до 60 р, які здобувають фахову передвищу та вищу освіти, асистенти-стажисти, аспіранти та докторанти, які навчаються за кордоном за денною або дуальною формами здобуття освіти (студенти, слухачі). На кордоні необхідно надати довідку про відстрочку, видана військкоматом про тимчасову непридатність (від 1 до 6 місяців) до військової служби. Чинне законодавство не містить норм щодо відповідальності за відрахування студента з ВУЗу. Країна має право повертати осіб в порядку Екстрадиції.
