На подвір’ї було багато крові.. Чи буду я нести відповідальність? Як доказати свою невиновність в нанесенні тяжких тілесних ушкоджень? Які мої дії, якщо обвинувачують у злочині??? Потрібен адвокат!!”

19.12.2020 22:40:35 Доброго дня, перше, що хотілося б пояснити, що стаття, за якою відкрито кримінальне провадження передбачає наявність числу на заподіяння тілесних ушкоджень. Враховуючи що особисто ви не заподіяли шкоду, то довести вашу провину буде складно. Разом з тим вам слід притримуватися версію, що капкан ви поставили на диких звірів, наприклад лисицю, яку ви часто баю вчили у вашому дворі. Тяжкість тілесних ушкоджень встановлюється висновком судового медичного експерта, після того як слідчий призначить відповідну експертизу. Акцентуйте увагу на тому, що невідома особа без вашого дозволу опинилася у вашому дворі, тобто її дії були неправомірними. Щодо капкану то вкажіть, що хтось із вашого оточення мисливець і забув колись давно капкан у вас наприклад чи що знайшли колись у дворі під час прибирання щось таке. Це до того, що ви не вчинили активних дій щодо підшукувавання знаряддя для подальшого використання із метою нанести школу здоров’ю потерпілому.
