Recently, our team was asked a question: “У мене була судимість, 1 рік умовного терміну. Цей термін минув, був суд, все було добре, судимість зняли. Чи є в базах ця справа, чи зможуть при прийомі на роботу побачити цю судимість?”

15.04.2025 19:23:05 Після зняття судимості інформація про неї зазвичай не відображається в загальнодоступних базах даних. Однак, деякі державні органи або правоохоронні структури можуть мати доступ до таких записів навіть після зняття судимості. При прийомі на роботу стандартна перевірка зазвичай не включає доступ до таких специфічних баз даних, якщо це не передбачено законодавством або специфікою роботи (наприклад, для державної служби чи роботи в правоохоронних органах). Якщо ви турбуєтеся про можливість перевірки вашого минулого роботодавцем, варто уточнити у них політику щодо перевірки судимостей і які саме джерела вони використовують для цього. У більшості випадків звичайні роботодавці не мають доступу до інформації про зняті судимості.
15.04.2025 20:02:20 Вітаю. Згідно з чинним законодавством, після того як судимість була знята за рішенням суду, інформація про неї має бути вилучена з реєстрів, які використовуються для перевірки судимостей. Тобто, якщо офіційно оформлено, що судимість знято, вона не повинна відображатися у базах даних, що ведуть відповідні органи держави.
15.04.2025 21:58:28 Відповідно до пункту 1 статті 89 ККУ - особи, засуджені відповідно до статті 75 ККУ, якщо протягом іспитового строку вони не вчинять нового кримінального правопорушення і якщо протягом зазначеного строку рішення про звільнення від відбування покарання з випробуванням не буде скасоване з інших підстав то визнаються такими, що не мають судимості. Тобто, якщо пройшов 1 рік вашого іспитового строку і все пройшло добре, то по завершенні відбування іспитового строку ви визнаєтесь таким, що не маєте судимості, а якщо було додаткове покарання, то після завершення додаткового покарання.
