30.01.2025 15:13:34 Для оформлення спадщини сину, який знаходиться за кордоном, необхідно звернутися до нотаріуса в Україні. Спочатку потрібно отримати копію заповіту і свідоцтво про смерть матері. Потім син повинен скласти довіреність на представника в Україні, який буде представляти його інтереси у спадкуванні. Далі представник повинен буде звернутися до нотаріуса для складання акта про спадкове право сина на майно матері. При цьому необхідно мати при собі всю необхідну документацію, а також паспорт особи, яка отримує спадщину. Пам'ятайте, що у разі виникнення будь-яких питань чи труднощів у процесі оформлення спадщини краще звертатися до кваліфікованих фахівців - нотаріуса чи юриста.

31.01.2025 09:55:05 Вітаю! Сину протягом 6 місяців з моменту відкриття спадщини потрібно подати нотаріусу заяву про прийняття спадщини. Варіанти: 1. Особисто подати заяву в консульство України за кордоном 2. Відправити заяву поштою, справжність підпису якої нотаріально засвідчена у іноземного нотаріуса (у такому разі сину необхідно звернутися до нотаріуса за конрдоном та завірити заяву про прийняття спадщини на 2х мовах (за необхідності проставити апостиль), а потім відправити її рекомендованим листом нотаріусу на території України, який відкрив спадкову справу). 3. Син може відіслати нотаріусу на території України заяву без нотаріального завірення (не звертаючись до закордонного нотаріуса). Проте, якщо заява, на якій справжність підпису спадкоємця не засвідчена, надійшла поштою, вона приймається нотаріусом, заводиться спадкова справа, а спадкоємцю повідомляється про заведення спадкової справи та необхідність надіслати заяву, оформлену належним чином.

Дії сина: Відкрити спадкову справу Це робить будь-який нотаріус в Україні за місцем проживання матері. Термін подання заяви – 6 місяців з дня смерті. Якщо син за кордоном: Він може надіслати заяву про прийняття спадщини через консульство України. Або оформити довіреність на представника (родича, адвоката) та переслати в Україну. Після 6 місяців нотаріус видає свідоцтво про право на спадщину. Зареєструвати майно в Державному реєстрі речових прав через нотаріуса або ЦНАП.
