Відмова в отриманні посвідки

Recently, our team was asked a question: “Доброго дня. Мій чоловік іноземець приїхав з візою по шлюбу і подав на посвідку на тимчасове проживання. Прийшла відмова що подали завідомо недостовірну інформацію. Що робити? Переподавати на посвідку чи що?”

14.03.2021 22:01:12 Доброго дня, у разі відмови Іноземець або особа без громадянства протягом місяця з дня отримання копії рішення про відмову у видачі посвідки на тимчасове проживання має право на його оскарження до ДМС України або суду. При цьому керуватися слід законом України «про правовий статус іноземців та осіб без громадянства», постанова кабінету міністрів України від 2017 року про затвердження порядку отримання посвідки на тимчасове проживання», від 2016 року «про деякі питання надання адміністративних послуг у сфері міграціі» та наказ мвс від 2013 року «про затвердження порядку розгляду заяв про отримання посвідки на тимчасове проживання». Чіткий перелік відмови в отриманні посвідки встановлено вказаними нормативно-правовими документами. Якщо термін звернення до суду минув то можете заявити клопотання про поновлення строку на звернення до суду із конкретних поважаних причин або повторно звернутися із отриманням посвідки і оскаржити вже нову відмову у встановлений строк

15.03.2021 21:48:32 Щоб з'ясувати, яка саме інформація є недостовірною, зверніться до органу Державної міграційної служби з письмовим запитом. У запиті просить вказати, яку конкретно інформацію визнали недостовірною та з яких підстав. Запит відправляйте цінним листом з описом вкладення. Приблизно через 30 днів ви отримаєте відповідь. Тоді або виправте недоліки в документах та подайте їх повторно, або оскаржуйте відмову у видачі посвідки - спершу до керівника того відділу ДМС, куди подавали документи, потім до обласного управління, а далі - до Головного управління ДМС у місті Києві. Якщо оскарження до ДМС нічого не дадуть, подавайте позов до адміністративного суду про визнання відмови незаконною та зобов'язання видати посвідку. Скарги до ДМС знадобляться вам, щоб довести суду, що ви звертались за отримання посвідки як це передбачено законом, але у зв'язку з відмовами змушені звернутись до суду. Краще, щоб позов до суду вам підготував юрист чи адвокат, бажано з досвідом в міграційному праві.
