30.08.2024 09:57:57 Якщо брат помер без заповіту, його спадкоємцями будуть його дружина та дитина. Таким чином, ви як сестра не будете мати права на спадщину вашого брата, якщо у нього є законні спадкоємці. Щодо виплати огд, якщо ваша мати померла до отримання цієї виплати, то вона може перейти до її спадкоємців - в даному випадку до вас як сестри. Однак, зверніть увагу на те, що спадщина розподілиться між всіма спадкоємцями за законом про спадкування. Рекомендую звернутися до адвоката для отримання консультації та детального роз'яснення вашої ситуації.
30.08.2024 10:50:46 Ні не можете. Єдина передбачена для Вас можливість, це наявність заповіту від брата на отримання вами всієї суми ОГД або її частки. У даному випадку на виплату в першу чергу має право дружина та дитина яка не досягла 18 років. Ви можете претендувати на ОГД лише у разі, якщо дружина та дитина відмовляться від виплати або не звернуться за нею протягом 3 років.

У разі загибелі передбачена для батьків, дітей, дружини (чоловіка) військовослужбовця) або ж особи яка була на його утриманні! Виняток: якщо Ви доведете що Ви були на утриманні брата - в такому випадку Ви матимете право претендувати на виплату в рівних частках разом з дружиною та дитиною 2. Якщо братом було складно особисте зобовʼязання щодо розпорядження 15 млн після його загибелі - і відповідно він зазначив в зобовʼязання Вас! Як правило питання щодо особистого розпорядження поки визначено лише на законодавчому рівні! На практиці випадків щоб виплачували по особистих зобовʼязаннях на разі немає
