Звільнення від кримінальної відповідальності за СЗЧ можливе тільки на основі клопотання прокурора. Це означає, що саме прокурор має отримати інформацію від військовослужбовця щодо його бажання повернутися на військову службу. якщо СЗЧ чи дезертирство було пов'язане з небажанням проходити службу в певному підрозділі, це дає можливість потрапити в інший. Також потрібна письмова згода від командира військової частини на продовження проходження військової служби. Її має отримати прокурор або суд. Щоб зовсім не служити та уникнути покарання - це навряд.
