26.03.2021 15:34:55 Для початку слід встановити як у лікарні зафіксована подія - виробнича травма або побутова, тобто отримайте медичні документи з медичної установи, яка надавала вам допомогу. Також слід від підприємтсва витребувати накази про прийняття на роботу, про призначення на посаду, ваші посадові обов’язки чи інструкції та акт складений за результатами розслідування нещасного випадку на виробництві. Також вас повинні були перед допуском до робіт проінформувати про заходи безпеки і інші моменти, що повинно бути зафіксовано під ваш підпис. Кожен працівник застрахований, а виплати проводить фонд соціального страхування України на підставі акту комісії про який я казав вище. Якщо ваша травма «пройшла» як побутова, а на підприємстві не зафіксована, то радив би писати заяву до поліції та органу держпраці, які в межах компетенції встановлять всі обставини і покарають керівника, а ви зможете отримати відшкодування. 29.03.2021 15:46:13 Роботодавець зобов'язаний створити на підприємстві нешкідливі та безпечні умови праці (стаття 153 Кодексу Законів про працю України). Ураховуючи позицію директора, вам доведеться стягувати компенсацію з роботодавця в суді. До подання позову вам треба отримати довідку від медичного закладу, куди вас доставили після нещасного випадку. У довідці має бути написано, що вас доставили в лікарню з місця роботи. Також вам треба підготувати документи, що підтвердять наявність трудових відносин з роботодавцем (копія наказу про прийняття на роботу, копія трудової книжки з відмітками про працевлаштування та звільнення, примірник трудового договору, копію наказу про звільнення). Ці документи ви можете отримати у відділі кадрів підприємства, або направити письмовий запрос (якщо добровільно вам документи не нададуть). За наявності документів, що нещасний випадок стався з вами на роботі, суд стягне з роботодавця компенсацію за отриману вами травму. Зверніться за допомогою до адвоката. Для вас так краще
