До членів сімей загиблих (померлих) осіб належать: діти, у тому числі усиновлені, зачаті за життя загиблої (померлої) особи та народжені після її смерті, а також діти, стосовно яких загиблу (померлу) особу за її життя було позбавлено батьківських прав; вдова (вдівець); батьки (усиновлювачі) загиблої (померлої) особи, якщо вони не були позбавлені стосовно неї батьківських прав або їхні батьківські права були поновлені на час її загибелі (смерті); внуки загиблої (померлої) особи, якщо на момент її загибелі (смерті) їх батьки загинули (померли); жінка (чоловік), з якою (з яким) загибла (померла) особа проживали однією сім’єю, але не перебували у шлюбі між собою або в будь-якому іншому шлюбі, за умови що цей факт встановлено рішенням суду, яке набрало законної сили; утриманці загиблої (померлої) особи. Згідно із частиною першою статті 232 СК України з моменту здійснення усиновлення припиняються особисті та майнові права і обов’язки між батьками й особою, яка усиновлена, а також між нею та іншими її родичами за походженням. При усиновленні дитини однією особою ці права та обов’язки можуть бути збережені за бажанням матері, якщо усиновлювачем є чоловік, або за бажанням батька, якщо усиновлювачем є жінка. Зберіть необхідний пакет документів та подайте до ТЦК, адже в постанові КМУ 168 не вказано, що діти, які усиновлені іншим чоловіком не мають права на виплати.
