Recently, our team was asked a question: “Доброго дня,в мене така ситуація,я громадянин України в мене в Грузії є рідний дядько громадянин Грузії який потребує догляду, дітей в нього немає, тільки я,єдиний повнолітній племінник,в Грузії я оформлений як його опікун,нотаріально завірений.
Також я не придатний до військової служби за станом здоров'я до кінця 2024р. ,мені виданий тимчасовий військ.квиток.
Чи можу я виїхати та які документи мені потрібно для виїзду за кордон?

09.06.2022 20:12:36 Якщо у Вашому тимчасовому посвідченні запис про виключення з військового обліку по непридатності або є висновок ВЛК, яким Ви тимчасово непридатний до військової служби, то з такими док-ами Ви маєте право виїхати за останніми актуальними розясненням прикордонної служби від 03.05.22 на сайті https://dpsu.gov.ua/ua/Peretinannya-derzhavnogo-kordonu-v-umovah-pravovogo-rezhimu-vonnogo-stanu/. Але, якщо спиратися тільки на догляд родича в Грузії, то не випустять, адже виїхати можна разом з ним для його супроводу (а не Вам, до нього для догляду), як особи, яка потребує постійного догляду, у супроводі особи (тобто Вас), яка здійснює постійний догляд (див. розяснення прикордонної за посиланням вище)

Якщо за висновком ВЛК Ви не придатний до військової служби, для виїзду за кордон необхідний висновок ВЛК та відмітка у військовому квитку про надання відстрочки від призову за мобілізацією на підставі абз.3 ч.1 ст.23 ЗУ "Про мобілізаційну підготовку та мобілізацію". Сам же догляд за родичем, який проживає за кордоном, не дає вам підстави виїхати. Це можливо лише у разі Вашого там постійного проживання, що має бути підтверджено консульською установою.
10.06.2022 10:11:26 Доброго дня. Так можете. Вам потрібно мати при собі паспорт військовий квиток та документ, який підтверджує, що Ви є опікуном людини, що потребує догляду. Дякую.
