Recently, our team was asked a question: “Доброго дня шановні юристи. Підскажіть таке питання. У мене є науковий ступінь доктор юридичних наук, але перед війною я звільнився з одного вузу та не встиг влаштуватись в інший, зараз фактично безробітний. Науковий ступінь на скільки мені відомо звільняє від призову. Чи зможу я зараз виїхати за кордон ? І друге питання, якщо мене тут все таки призначать на посаду до вузу, чи тоді зможу виїхати?”

10.04.2022 08:39:39 По абз.3 ч.3 ст.23 ЗУ «Про мобілізаційну підготовку та мобілізацію» призову на військову службу під час мобілізації, на особливий період не підлягають також наукові і науково-педагогічні працівники закладів вищої та фахової передвищої освіти, наукових установ та організацій, які мають вчене звання та/або науковий ступінь … за умови що вони працюють відповідно у закладах вищої чи фахової передвищої освіти, наукових установах та організаціях, закладах загальної середньої освіти за основним місцем роботи не менш як на 0,75 ставки. Ви не підлягаєте призову під час мобілізації, але не зможете виїхати через п.2-6 Правил перетинання держ.кордону, затв. пост.КМУ від 27.01.1995 №57 (зі змінами від 01.04.2022) «у разі введення … воєнного стану право на перетин державного кордону … також мають інші військовозобов’язані особи, які не підлягають призову на військову службу під час мобілізації. Ця норма не поширюється на осіб, визначених в абз.2-8 ч.3 ст.3 23 ЗУ "Про мобілізацію"
