Виїзд за кордон під час воєнного стану

Recently, our team was asked a question: “Чи може чоловік, непридатний до військової служби у мирний час і частково непридатний до військової служби у воєнний час виїхати за кордон? Був знятий з військового обліку, але у зв'язку з переїздом і зміною місця прописки був поставлений на облік знов.”

15.04.2022 07:54:19 Ви не правильно назвали свій стан, буває непридатний до ВС у мирний час, але частково придатний у воєнний час. Постановка на облік правомірна, при зміні місця проживання це передбачено ч.1 і 5 ст.37 ЗУ «Про військовий обов'язок….». Виїхати можливо при непридатності за висновком ВЛК (військово-лікарської комісії) до служби з виключенням з військового обліку (по п.3 ч.6 ст.37 ЗУ «Про військовий обов'язок...»), але треба походити ВЛК. Також, по ч.1 ст.23 ЗУ «Про … мобілізацію» не підлягають … мобілізації військовозоб.чоловіки, які відповідно до висновку ВЛК є тимч.неприд.до ВС за станом здоров’я на термін до 6 місяців (з наступним проходженням ВЛК). Тоді Вас не буде підстав мобілізувати до наступного ВЛК, підставою для виїзду може бути п.2-6 Правил перетинання держ.кордону, затв. пост.КМУ від 27.01.1995 №57 (зі змінами від 05.04.2022) «у разі введення … воєнного стану право на перетин держ.кордону … також мають інші військовозоб.особи, які не підлягають призову на ВС під час мобіліз.

16.04.2022 20:08:59 Доброго дня. Постановою КМУ 5-7 від 28.01.1995 зі змінами та доповненнями, визначено перелік осіб які у разі введення на території України надзвичайного або воєнного стану, мають право перетнути державний кордон. Непридатність до військової служби підтверджується довідкою до акту огляду медико-соціальною експертною комісією або відповідним посвідченням. Маючи зазначені документи в період военого стану ви можете виїхати за кордон.
