08.05.2022 10:06:36 Малолітньою вважається дитина до досягнення нею 14 років; неповнолітньою вважається дитина у віці від 14 до 18 років. Закон встановлює мінімальний вік статевої згоди відповідно до рекомендацій Комітету ООН з прав дитини. Крім того, встановлюється, що зґвалтування здійснює саме повнолітній, оскільки він має усвідомлювати суспільно небезпечний характер такої поведінки. При цьому закон не регулює статеві відносини між неповнолітніми за взаємною згодою. За нинішніми нормами, питання про досягнення статевої зрілості вирішує судово-медична експертиза. За статтею 156 КК «Розбещення неповнолітніх» передбачено покарання за вчинення розпусних дій щодо особи, яка не досягла 16 років. І є стаття 155 КК, яка передбачала покарання за статеві зносини, але — — з особою, яка не досягла статевої зрілості
08.05.2022 12:10:38 Доброго дня. Ніякої відповідальності хлопцю за те, що в нього переночувала подруга не буде. Якщо мова йде про сексуальні відносини то ст. 155 КК України передбачена відповідальність за зчинення дій сексуального характеру з особою, яка не досягла шістнадцятирічного віку.
