Батько був громадянином Росії , з постійною посвідкою на проживання в Україні. Проживав в Україні з 1993 року. Нотаріус говорить, що мені потрібно заплатити налог за те зо батько іноземець . Скільки потрібно заплатити відсотків від суми нерухомості в державу при оформленні квартири? Як вступити в спадщину в Україні? Які документи потрібні для вступу в спадщину за заповітом ?”

18.12.2020 15:48:28 При отриманні спадку від іноземця сплачується податок на доходи фізичних осіб - 18 відсотків від вартості спадкового майна (квартири). Це правило діє і у вашому випадку, незважаючи на те, що спадок ви отримуєте від рідного батька. Для отримання спадщини за заповітом ви маєте звернутись до того нотаріуса, який склав заповіт, предявити йму свідоцтво про смерть батька та подати письмову заяву про прийняття спадщини за заповітом. Заяву про вступ у спадщину треба подати протягом 6 місяців з дня смерті вашего батька. Через 6 місяців закінчиться строк протягом якого інші родичі вашого батька матимуть право звернутись до нотаріуса за вступом у спадщину за законом (наявність заповіту не позбавляє інших родичів претендувати на майно вашого батька). Якщо ніхто з родичів за 6 місяців до нотаріуса не звернеться, ви будете єдиним спадкоємцем. Тоді нотаріус видасть вам свідоцтво про право на спадщину, яке є підставою для перереєстрації на вас права власності на нерухоме майно.

24.12.2020 19:15:19 З описаної Вами ситуації вбачається, що Ваш батько є резидентом України. Якщо Ви є громадянином України то отримана спадщина буде оподатковуватись з нульовою ставкою, тобто, ніяких податків платити не потрібно. Якщо Ви є нерезидентом, то до моменту отримання свідоцтва про право на спадщину Ви маєте сплатити ПДФО у розмірі 18% та військовий збір у розмірі 1,5% від вартосі успадкованого майна. Для прийняття спадщини зверніться до нотаріуса (державного або приватного) за останнім місцем проживання Вашого батька. З собою ам потрібно буде мати паспорт, ідентифікаційний номер та заповіт.
