10.08.2022 22:43:24 Сейчас, в связи с военным положением, порядок выезда детей за рубеж упростили. Можно вывезти ребенка без согласия отца, если ребенок будет выезжать вместе с матерью. Если ребенок будет выезжать с кем-то другим из родственников (дедушка, бабушка), тогда разрешение от родителей ребенка необходимо.

Під час воєнного стану не діє правило, за яким, якщо дитина виїжджає у супроводі одного з батьків, то інший має надати нотаріальну згоду на це. Якщо є можливість оформити дозвіл - то краще зробити. Оскільки вимоги можуть змінитись у будь-який день. Також варто перед поїздкою уточнити інформацію у Державної прикордонської служби України: 1598 для дзвінків з території України (лінія безкоштовна);

В умовах воєнного стану дитина може перетинати кордон у супроводі одного з батьків без нотаріальної згоди другого, діда чи баби, повнолітніх сестри чи брата, вітчима/мачухи при наявності документа, який підтверджує родинні зв’язки. Якщо дитина виїжджає з кимось іншим, не з цього переліку, обов’язково має бути письмова згода від когось одного з батьків, засвідчена в органах опіки і піклування. Або нотаріальна згода від двох батьків. Самостійно, без супроводу і письмової згоди батьків, дитина може виїжджати за межі України з 16 років. Але в різних країнах законодавство відрізняється і це може давати певні обмеження. До прикладу, якщо діти віком 16-18 років приїхали до Польщі без батьків чи законних опікунів, вони вважатимуться там дітьми без нагляду. За польськими законодавчими нормами, їх можуть помістити у заклади для тимчасового перебування, поки їх не заберуть законні представники – батько, мати або інша людина, яка уповноважена ними нотаріально.
