Если военкомат отказывает в приеме документов, можно обратиться в другие государственные органы или правозащитные организации за помощью. 12.01.2025 16:05:10 Вітаю, повнолітні діти можуть отримати ці виплати тільки якщо були на утриманні батька. До утриманців належать члени сім’ї померлого, що перебували на його утриманні, якщо вони були на його повному утриманні або одержували від нього допомогу, яка була для них постійним та основним джерелом засобів до існування. Наприклад, це непрацездатні повнолітні діти, повнолітні діти до 23 років, які отримували аліменти у зв’язку із навчанням, брати, сестри та онуки, які не досягли 18 років або старші цього віку, якщо вони стали особами з інвалідністю до досягнення 18 років та перебували на повному забезпеченні загиблого. Це потрібно довести документально. В іншому випадку відмова правомірна. Окрім утриманців право на виплату мають: батьки загиблого одне з подружжя діти віком до 18 років

Згідно статті 16-1 Закону України «Про соціальний і правовий захист військовослужбовців та членів їх сімей» встановлює, що право на призначення та отримання одноразової грошової допомоги мають батьки, один із подружжя, який не одружився вдруге, ДІТИ, утриманці загиблого. Тому неприйняття документів представниками ТЦК - незаконне. Діти повинні вимагати письмову відмоу у прийнятті заяви на виплату ОГД та оскаржити її у судовому порядку. Також потрібно подати скаргу на ТЦК до обласного ТЦК і Міноборони. Ознайомтесь з ПЕРЕЛІКОМ ДОКУМЕНТІВ які надають члени сім’ї до районного (міського) ТЦКСП для призначення та виплати ОГД - https://zakon.rada.gov.ua/laws/show/z0176-23#n76
