Як оформити право власності на землю?

Recently, our team was asked a question: “Добрий день. Мій батько є власником земельної ділянки. На даний момент він перебуває закордоном та не планує повернутись в Україну. Як мені, його сину, можна оформити право власності на цю землю? Куди звернутись?”

Зареєструвати власність чи інші права на землю можна через місцевий центр надання адміністративних послуг (ЦНАП), який приймає документи для держреєстрації речових прав на нерухоме майно, або у нотаріуса. Саме після реєстрації в держреєстрі речових прав на нерухоме майно, виникає, змінюється чи припиняється відповідне право. Але власник не Ви, для початку Ваш батько повинен переоформити землю на Вас, наприклад через дарування, а вже потім Ви, як законний власник будете звертатись до нотаріуса чи до ЦНАП для подальшого оформлення документів. 19.10.2021 20:10:27 Ви можете бути розпорядником земельної ділянки, шляхом надання вашим батьком довіреності. Без нотаріальної згоди власника не можливо вчинити ніякі дії.
20.10.2021 21:12:44 Вам необхідно отримати довіреність від Вашого батька на оформлення землі (батько звертається до нотаріуса в Україні) або оформляй її за кордоном реєструє в посольстві, передає вам до України, а ви тут її перекладаєте та завіряєте. Якщо є державний акт на землю старого зразка, ймовірно, кадастровий номер ділянці не присвоєно. Перевірити це можна на Публічній кадастровій карті України, у якості критеріїв пошуку вказавши населений пункт, де знаходиться земельна ділянка, чи її координати.Для того, щоб присвоїти кадастровий номер, потрібно звернутися до найближчого розробника документації із землеустрою для виготовлення технічної документації щодо встановлення (відновлення) меж земельної ділянки в натурі (на місцевості). Коли кадастровий номер присвоєно, коректні відомості про земельну ділянку вже оцифровані - відображені в Державному земельному кадастрі, офіц статусу власника землі у Держ реєстр тобто в ЦНАП.
