Recently, our team was asked a question: “Добрий день. Наша фірма приймала участь в тендері від ОТГ, нам сказали що ми не підійшли по умовах. Але в умовах був товар, який важкодоступний і його поставки чекати мінімум 60 днів. В конкурента він був, тому конкурент виграв. Виглядає ніби підстава і корупція. Як перепровести тендерина нормальних умовах?”

03.01.2022 22:19:43 Підстава відмови досить дивна, вам необхідно детально ознайомитись з протоколом УО про відхилення вашої пропозиції всі документи знаходяться на сайті прозоро ви можете їх також знайти авторизовавшись через свій майданчик. Також вам необхідно детально вивчити документацію конкурентів на наявність недоліків, також зверніть увагу та ті ж підстави з яких було відхиллено вашу пропозицію. Наступні ваші дії - якщо це були відкриті торги - то оскаржуйте до АМКУ, якщо спрощена закупівля то зверніться до господарського суду. Для звернення до суду необхідні вагомі підстави а краще декілька підстав. Також якщо ви впевнені в корупційних діях то варто про закупівлю написати відгук на сайті громадського контролю https://dozorro.org/. Також зважайте, що для оскарження обмежений термін для звернення або до суду або до АМКУ тому переглядайте документи та дійте, але не зайвим буде також залучитись допомогою юриста, що спец. на закупівлях.
10.01.2022 13:52:55 У даному випадку Вам потрібно подати скаргу до Антимонопольного комітету України через електронний майданчик де оголошувався тендер. Важливо, коли оскаржується рішення замовника тендера яким обрано переможця, така скарга подається протягом 10 днів з моменту коли Ви довідались або могли довідатись про порушення (підставу чи корупцію). Для складення тексту скарги та її подачі звертайтесь до юриста.
