У разі, якщо Ваші авторські права порушено, Ви можете звернутися безпосередньо до особи, яка незаконно розмістила Ваш витвір без посилання, із заявою про припинення порушення. Якщо вимога буде залишена без задоволення, Ви маєте право звернутися до суду. За порушення авторського права передбачено наступні види відповідальності: цивільна (ст. 431 ЦК), де вказано, що таке порушення тягне за собою відповідальність, встановлену зазначеним Кодексом, іншим законом чи договором; адміністративна (ст. 51-2, 164-9, 164-13 КУпАП); кримінальна (ст. 176, 203-1, 216 КК). 19.06.2021 22:39:52 Доброго дня, за порушення прав інтелектуальної власності, авторського права та суміжних прав існує цивільно-правова відповідальність, адміністративна відповідність та кримінальна відповідальність. Слід керуватися нормами цивільного кодексу, Конституції України, закону України «про авторське право», кодекс адміністративного судочинства, кримінальний кодекс України. Залежить від вашого бажання покарати порушника. Проте потрібно буде довести що ви автор, що ваше право порушено та обрати спосіб захисту.
