Як відновити батьківські права

Якщо мати або батько, які були позбавлені батьківських прав, хочуть їх відновити - вони можуть це зробити тільки в судовому порядку. Для цього необхідно звертатися в суд з відповідним позовом.
Суд розглядає цей позов і задовольняє тільки після того, як переконається в кардинальних позитивних змін у поведінці позивача, припинення дії обставин, через які позивач був позбавлений батьківських прав, а також в тому, що після відновлення батьківських прав позивача не будуть порушені інтереси дитини.
Однак потрібно вказати на умови, коли відновити батьківські права позивача не представляється можливим:
- дитина вже кимось усиновлена і цей факт ніким не оскаржений і не скасований на момент подачі позову і його розгляду судом;
- дитині до моменту розгляду справи 18 років вже виповнилося.
Якщо зміни настільки радикальні, що позбавлений батьківських прав не несе загрози дітям, а відновлення його батьківських прав не буде суперечити інтересам дитини, суд може прийняти позитивне рішення.
Після набрання рішенням чинності, його копія направляється в РАГС, в якому зареєстровано народження дитини, де в реєстрі відновлюється запис про того з батьків, який був позбавлений батьківських прав.
Якщо суд вважатиме, що наведені аргументи недостатні, і не визнає за можливе відновити батьківські права, він відмовляє в задоволенні позову.
В такому випадку, повторно звернутися до суду з аналогічним позовом можна не раніше, ніж через рік, після того, як вступить в силу рішення про відмову. Основним документом, який необхідний для початку процедури по відновленню батьківських прав, є позовна заява. Крім нього слід надати такі документи:
- висновок про обстеження житлового приміщення;
- довідка про заробітну плату;
- характеристика з місця роботи;
- характеристика від місцевого дільничного;
- довідки про стан здоров'я від психолога, нарколога;
- характеристика від сусідів;
- характеристика від товаришів по службі;
- довідка з ЖЕКу і виписка з будинкової книги;
- копії паспорта;
- копії свідоцтва про народження;
- копії свідоцтва про шлюб.
