У меня ФОП, из за того что бизнес стал больше сейчас хотим перейти на ТОВ, проанализировав рынок юридических услуг, понял что хороший юрист стоит дорого, можно ли это сделать самостоятельно и сэкономить, без помощи опытного юриста, если да, то как правильно юридически оформить ТОВ самостоятельно?

19.11.2020 19:03:39 Доброго дня. Ви можете і залишатись ФОП і водночас працювати через ТОВ. Ви можете зателефонувати державному реєстратору свого району і дізнатись які документи слід подати, скільки державного мита заплатити за реєстрацію і реквізити, куди саме платити. Реєстраційна форма загальнодоступна в інтернеті. Щодо статуту, то ТОВ може працювати на підставі модельного статуту, тобто типового. Інші документи теж можна спробувати знайти в мережі. Реєстратор при реєстрації ТОВ перевірить їх, тому якщо будуть помилки поверне. Отже, можете спробувати самі зареєструвати ТОВ. Але якщо вам потрібно швидко і немає часу дзвонити чи вивчати питання в мережі, ви завжди можете знайти доступного для вас юриста.

19.11.2020 19:10:17 Процедура перехода на ООО предусматривает следующие действия: составление устава ООО, который должен соответствовать положениям Закона Украины "Об обществах с ограниченной и дополнительной ответственностью"; составления протокола о создании ООО, заполнения заявления о государственной регистрации юридического лица. Заявление о государственной регистрации и протокол создания ООО должны соответствовать Закону Украины "О государственной регистрации", иначе документы на регистрацию у вас не примут. После проведения регистрации предстоит подавать документы в налоговую инспекцию для постановки на налоговый учет. Я занимаюсь регистрацией ООО на постоянной основе, и скажу вам так - это большой объем кропотливой работы, требующий знания законов и опыта в этой сфере. Если вы разбираетесь во всех тонкостях создания ООО - займитесь самостоятельно. Если нет - не скупитесь на юриста. Найти приемлемое ценовое предложение вполне реально.
