Recently, our team was asked a question: “Зняли з потяга Київ-Пасажирський - Перемишль. У військовому квитку печатка: "Знятий з військового обліку згідно наказу МОЗ України №342 від 09.06.06р." Крім паперового Рішення прикордонників є офіційний лист ДПС про те, що рішення правомірне на підставі ст.14 Закону України "Про прикордонний контроль". Це правомірно?”

08.06.2022 11:38:49 Скоріше за все рішення правомірне, проте для достовірності необхідно ознайомитись з вашими документами та рішення ДПС. Наказ №342 від 09.06.06р. втратив чинність а відомості у вашому військовому квитку на дату перетину кордону вже не актуальні. Рішення про зняття з обліку відбувається на підставі Наказу МОУ №402 від 14.08.08 Наказ МОУ №342 п.2.3 від 09.06.06 р. втратили чинність відповідно до наказу МОУ "Про внесення змін до Настанови з військового обліку прапорщиків, мічманів, сержантів, старшин, солдатів і матросів запасу в Збройних Силах України та інших військових формувань" №24 від 15.01.15 . Особа, якій відмовлено у перетинанні державного кордону, має право оскаржити відповідне рішення згідно із ЗУ "Про звернення громадян" або до суду. Оскарження зазначеного рішення не зупиняє його дії. Оскаржене рішення може бути скасовано чи змінено начальником органу охорони державного кордону або скасовано та визнано нечинним судом.
