Recently, our team was asked a question: “Яка юридична сила попередньої довідки ВЛК про тимчасову непридатність, яка відправлена на узгодження до міського та обласного тцк ? Чи можна її пред'являти представникам ТЦК та СП? Чи можуть тцк та сп змусити в іншому місці повторно проходити ВЛК до моменту за затвердження цієї довідки обласним тцк ?”

08.10.2024 12:34:29 Попередня довідка ВЛК про тимчасову непридатність має певну юридичну силу, але вона може бути скасована або змінена після узгодження з міським та обласним ТЦК. Представники ТЦК та СП можуть запросити додатковий медичний огляд або переглянути рішення ВЛК. Проте, ТЦК та СП не можуть примусити особу проходити повторний медичний огляд в іншому місці до отримання погодженого рішення обласного ТЦК. Ця ситуація порушувала б законодавство про права людини і гарантоване національною конституцією право на захист здоров'я.
