Recently, our team was asked a question: “Нас заставляють працювати під час повітряної тривоги, чи можуть начальство притягти до відповідальності і по якій статі??? Ми не знаходимось а зоні бойових дій. Хоча від нас 3 км. попала ракета, де було біля 100 загиблих і ще більше поранених. В нас по 3-5 тривог буває.Рядом інші підприємства всі ховаються.”

09.04.2022 20:51:27 Повітряна тривога під час дії воєнного стану не буває навчальною – кожного разу під час її оголошення існує реальна загроза життю. Кожного разу треба спускатися в укриття, а торгівельним закладам припиняти роботу. Проте виганяти людей на вулицю, якщо поруч немає укриття, заборонено. Питання роботи закладів торгівлі під час повітряної тривоги та реагування на порушення з цього приводу знаходиться в компетенції керівників територіальних громад та Держпродспоживслужби, та військову Адміністрацію про порушення вашим роботодавцем режимів роботи та змужування працювати підчас повітряної тривоги. Якщо ви не заявляєте компетентним органам, то вони не можуть не провести роз'яснювальну роботу не застосувати заходи впливу до вашого роботодавця, так як їм просто про зазначенні зловживання безпекою не відомо.

12.04.2022 17:24:16 Відповідальності за продовження роботи підприємства під час повітряної тривоги в законодавстві України немає. Якщо працівник не погоджується працювати в нинішніх умовах, він може: 1.Оформити оплачувану відпустку тривалістю 24 календарних дні, або неоплачувану відпустку на весь період дії воєнного стану та поїхати в інший регіон у межах України, де немає повітряних тривог і перечекати там до кінця війни; 2.Призупинити трудові відносини з роботодавцем до закінчення воєнного стану, подавши до відділу кадрів роботодавця відповідну письмову заяву; 3.Звільнитись з підприємства у зв’язку з побоюваннями за власне життя та здоров’я. Але притягнути роботодавця до відповідальності при оголошенні повітряної тривоги ви не зможете з простої причини. В вашому регіоні немає бойових дій. Повітряна тривога не означає, що ракета влучить саме у підприємство, на якому ви працюєте, і зашкодить вам. Поки в вашому регіоні відсутні бойові дії, роботодавець закон не порушує.
