23.10.2024 19:21:40 Поняття "знайти" та "виключений" з військового обліку є різними. "Знайти" означає включення особи до списку військового обліку, тобто виявлення і реєстрацію її як придатної для військової служби. "Виключений", навпаки, означає вилучення особи з цього списку, наприклад, у зв'язку з непридатністю для служби чи за іншими причинами. Отже, це два різних поняття з військового обліку.
25.10.2024 21:55:25 Вітаю! Різні. Виключений - невійськовозобов'язаний та не підлягає поновленню на військовому обліку. Знятий - військовозобов'язаний та його можуть взяти на облік. Ознайомтесь зі статтею 37 ЗУ "Про військовоий обов'язок та військову службу"
26.10.2024 17:09:28 Вітаю, це різні поняття! Знятий з військового обліку не скасовує статусу військовозобов'язаного. Тобто громадянин продовжує проходити ВЛК, оновлювати військово облікові дані. Зняття є тимчасовим і передбачає повернення на облік через певний час відповідно до обставин. Виключений з військового обліку – непридатний до служби повністю.
27.10.2024 20:08:48 Так, атже Закон України «Про військовий обов’язок та військову службу» має два визначення: 1) зняття з військового обліку; 2) виключення з військового обліку. Однією з підстав зняття з військового обліку військовозобов’язаних відповідно до підпункту 1 пункту 2 частини 5 статті 37 вищевказаного Закону України є вибування в іншу місцевість (адміністративно-територіальну одиницю) України до нового місця проживання. Однак на новому місці проживання особа повинна стати на військовий облік. Отже виключення на відміну від зняття з військового обліку має зовсім іншу юридичну природу, за своєю суттю це припинення дії військового обов’язку як такого для конкретної особи. А зняття у розумінні Закону України «Про військовий обов’язок та військову службу» – суто зміна місця (тобто ТКЦ та СП) або зміна облікового списку.
