Згідно Наказу МВС №1395 від 07.11.2015 Поліцейські при складанні протоколу повинні підписати його особою, яка його склала, і особою, яка притягається до адміністративної відповідальності. За наявності свідків і потерпілих протокол про адміністративне правопорушення підписується також цими особами. Після отримання копії постанови ви маєте право звернутися за захистом своїх прав до керівництва патрульного поліції. Але такі звернення часто ігнорують. Тому аби не витрачати час, відразу звертайтеся до суду. (часу у Вас 10 днів з моменту винесення постанови). Зразки позовних заяв є на сайті судів, також там можна продивитись інформацію про сплату державного мита та перелік документів, необхідних для подачі позову, або ж скористайтесь допомогою кваліфікованого адвоката. 13.09.2021 17:10:29 Доброго Дня Постанова про притягнення до адміністративної відповідальності можна оскаржити до суду шляхом подання позовної заяви. Згідно з останніми змінами в ст. 258 КУпАП, поліцейські не зобов'язані складати протокол про адмінправопорушення, зазвичай вони відразу виносять постанову, копію якої обов'язково вручають водієві. Штраф можна оскаржити в суді, посилаючись на ст. 288 Кодексу.
