11.09.2024 10:46:20 Згідно з чинним законодавством, вирок суду може бути змінений або скасований лише в порядку, передбаченому законом. Заміна покарання на проходження військової служби можлива тільки у випадках, коли це передбачено законом і являється альтернативним видом покарання. Також необхідно мати на увазі, що звільнення з військової служби за наявностю законних підстав можливе лише за умови дотримання всіх процедур і вимог, передбачених законодавством. Тому рекомендується звертатися до кваліфікованого адвоката для отримання консультації щодо можливостей оскарження вироку та подальшого розвитку подій.

Частина 1 статті 81-1 Кримінального кодеку України передбачає, що під час проведення мобілізації та/або дії воєнного стану до осіб, які відбувають покарання у виді обмеження волі або позбавлення волі на певний строк, судом може бути застосовано умовно-дострокове звільнення для проходження ними військової служби за контрактом. Тому покарання за СЗЧ можна замінити на проходження служби. Контракт осіб, яких умовно-достроково звільнено від відбування покарання на підставі, визначеній статтею 81-1 Кримінального кодексу України, припиняється (розривається) на підставі: а) за станом здоров’я б) у зв’язку з набранням законної сили обвинувальним вироком суду, яким призначено покарання у виді позбавлення або обмеження волі; в) у зв’язку із закінченням особливого періоду або оголошенням рішення про демобілізацію. Інших підстав для звільнення немає. Це прямо передбачено Статтею 21-5 ЗУ "Про військовий обов'язок та військову службу" З повагою, юрист Дерій В.О.!
