12.05.2023 11:29:11 Доброго дня! Так, можливо. Відповідно до ст. 23 ЗУ "Про мобілізаційну підготовку та мобілізацію". Вашому одному із синів, необхідно написати рапорт на командування до якого долучити документи, що підтверджують Вашу інвалідність.
12.05.2023 11:31:32 Доброго дня, за Законом України “Про військовий обов’язок і військову службу”, Законом України “Про правовий режим воєнного стану” звільнити можуть у зв'язку з: - з наявністю дружини (чоловіка) із числа осіб з інвалідністю та/або одного із своїх батьків чи батьків дружини (чоловіка) із числа осіб з інвалідністю I чи II групи; Але можна розгляниту всі обставини, які у вас є, можливо довідка ЛКК або встановлення опікунства. Пропоную вам надати розгорнутий правовий висновок, що б у вас була можливість ознайомитись зі всіма можливими способами звільнення. Якщо вам сподобалась моя відповідь - прошу її обрати як найкращу.
12.05.2023 11:46:51 Згідно з ст.26 ЗУ "Про військовий обов'язок і військову службу" звільнення військовослужбовця з військової служби під час дії воєнного стану може здійснюватися у зв’язку з необхідністю здійснення постійного догляду за хворою дружиною (чоловіком), дитиною, а також батьками своїми чи дружини (чоловіка), що підтверджується відповідним медичним висновком медико-соціальної експертної комісії або лікарсько-консультативної комісії закладу охорони здоров’я.
12.05.2023 19:48:02 Тільки у випадку, якщо ви потребуєте постійного стороннього догляду. Це підтверджується довідкою ЛКК або МСЕК.
13.05.2023 22:09:58 Інвалідність 3 групи не дає права на звільнення якщо у вас немає висновку про необхідність постійного стороннього догляду
15.05.2023 12:09:27 Доброго дня в Законі України Про мобілізаційну підготовку та мобілізацію (стаття 23) пишуть, що під час мобілізації військовозобов’язані, які мають дружину з числа осіб з інвалідністю, або батьків з інвалідністю першої чи другої групи, звільняються від призову. Отже 3 групи не вказано щодо батьків! Можна зібрати всі необхідні документи і встановити над особою з інвалідністю третьої групи опіку та піклування. У заяві посилайтесь на абз.11 ч.1 ст.23 ЗУ Про мобілізаційну підготовку та мобілізацію.
