22.08.2022 08:54:54 За цим фактом потрібно звертатись до суду, щодо визнання факту мобілізації незаконним та визнання наказу про мобілізіцію незаконним. Такі позови до суду вже є, та суд задовольняв такі вимоги. Тож сенс зібрати документи та подит до адмін суду варто. Також раджу написати рапорт на проходження ВЛК в частині, та вказати, що під час мобілізації дане обстеження не проводилось.
22.08.2022 19:55:48 Ні не можете, Загальний порядок звільнення військовослужбовців під час дії воєнного стану визначений вимогами статті 26 Закону України «Про військовий обов’язок і військову службу». Основними підставами для звільнення під час війни є: – за віком – у разі досягнення граничного віку перебування на військовій службі (для вищого офіцерського складу – 65 років, для решти військовослужбовців – 60 років); – за станом здоров’я – на підставі висновку (постанови) ВЛК про непридатність до військової служби з виключенням з військового обліку; – у зв’язку з набранням законної сили обвинувальним вироком суду, яким призначено покарання у виді позбавлення волі, обмеження волі або позбавлення військового звання; – через такі сімейні обставини або інші поважні причини (якщо військовослужбовці не висловили бажання продовжувати військову службу), це: у зв’язку з вихованням дитини з інвалідністю віком до 18 років; у зв’язку з вихованням дитини, хворої на тяжкі перинатальні ураження н
