Вітаю ст. 38 КЗпП визначає перелік поважних причин для розірвання трудового договору у необхідний працівнику час, без відпрацювання 2х тижнів. А саме: переїзд на нове місце проживання; переведення чоловіка або дружини на роботу в іншу місцевість; вступ до навчального закладу; неможливість проживання у даній місцевості, підтверджена медичним висновком; вагітність; догляд за дитиною до досягнення нею 14 років або дитиною з інвалідністю; догляд за хворим членом родини відповідно до медичного висновку або особою з інвалідністю I групи; вихід на пенсію; прийняття на роботу за конкурсом. Також Ви можете не відпрацьовувати 2 тижні якщо працедавець порушував Ваші трудові права, кол. договір.

Доброго дня! Кодекс законів про працю України передбачає низку випадків, у яких роботодавець зобов'язаний звільнити працівників у такий строк, про який вони просять. Випадки, коли на власника покладається обов'язок звільнити працівника в строк, про який він просить, перелічені в ст. 38 КЗпП (їх наявність мє бути підтверджена): 1) переїзд на нове місце проживання. 2) переведення одного з подружжя в іншу місцевість; 3) вступ до навчального закладу; 4) неможливість проживання в даній місцевості та інші поважні причини. В таких або іних випадках, які є поважними, Ви не зобов'язані відпрацьовувати 14 днів.
