All men who are fit for military service in terms of health and age, and are on the military register, are enrolled in the reserve of the Armed Forces of Ukraine. This applies to persons who have not yet reached the maximum age of service and make up the mobilization reserve. After reaching the age limit, such persons are excluded from registration and cannot serve in the armed forces, except for cases where they express a desire to continue their service.
We will consider the age up to which men are subject to mobilization and in which cases conscription is possible up to the age of 25.
Are men subject to mobilization before reaching the age of 25?
Yes, it is possible, if they have a military department or have completed their military service and were released into the reserve before 2022 (demobilized conscripts in 2024 will receive a deferment from mobilization for 12 months).
It is important to distinguish between the terms "conscript" and "conscript". Men under the age of 25 who have not served in the army and have no military experience are considered conscripts and are not subject to mobilization. However, those with military experience or a military department may be mobilized.
There are different military records for these two categories: separately for conscripts and separately for conscripts. Accounting is carried out on the basis of a passport and a certificate of registration for conscripts or a military ticket for conscripts.
Can a boy be mobilized under the age of 25 if he has not completed military service and does not have a military department?
Ukrainians under the age of 25 who have not served in the army and have conscript status can be mobilized only with their consent.
In practice, various situations often occur in territorial recruitment centers, including cases when a conscript receives a military registration document of a conscript or is even mobilized, although this should not be the case by law.
That is why the consultation and support of a mobilization lawyer are extremely important in such cases.
Why is the mobilization of people under the age of 25?
There is no clear procedure for transferring men under the age of 25, who were previously found to be of limited fitness for service, from the list of conscripts to the list of conscripts, even if they become fit after a second medical examination.
This applies to students who are completing a bachelor's degree and are planning to enter a master's degree, but when updating their data at the TCC with a temporary certificate of conscript issued as limited suitability, they may be referred to the medical board.
That is, even if a man is not eligible for service due to his age, but has the status of "limited fitness", he remains formally conscripted.
The previous mobilization legislation provided for such a norm, but the new legislation, which made changes, did not solve the problem of transferring men from the list of conscripts to the status of conscripts.
Amendments to Part 10 of Article 14 of the Law "On Military Duty and Military Service" excluded the wording "in peacetime, limited service in wartime, which are subject to being entered into the military register of conscripts" in accordance with the Law "On Amendments to Certain Laws of Ukraine on ensuring the rights of servicemen and policemen to social protection" dated March 21, 2024. However, there is no clear procedure for removing men, previously recognized as limited fit, from the list of conscripts and transferring them to the list of conscripts.
The role of lawyers in cases involving the mobilization of persons under the age of 25
Lawyers play an important role in mobilization cases for persons under 25, providing advice, representation in court, and protection of clients' rights. They provide information about rights and obligations, challenge illegal decisions of the TCC, represent interests in court proceedings, ensure compliance with legal procedures and monitor changes in legislation. Lawyers also provide psychological support and help in cases of illegal mobilization, providing comprehensive legal support for the protection of clients.
The importance of ordering legal support during mobilization
Ordering legal support during mobilization is extremely important for several reasons.
First, lawyers provide detailed information about the rights and obligations of persons subject to mobilization, helping to avoid violations of the law. They verify the correctness of the decisions of the TCC and military commissions, and also help to challenge illegal decisions that may lead to illegal mobilization.
Secondly, legal support includes representation in court, which allows you to effectively protect the client's interests and ensure compliance with all procedural norms. This also includes advising on documents, filing complaints and resolving other legal issues that may arise during mobilization.
In addition, lawyers provide psychological support and assistance in stressful situations, which can greatly facilitate the process of adaptation to new circumstances. In general, legal support is critical to ensure legal protection and guarantee fair treatment of persons subject to mobilization.
