PAYMENTS FOR MILITARY SERVANTS UPON DISCHARGE - LEGAL AID
Servicemen who are discharged from military service are entitled to certain benefits. The terms of these payments are regulated by the Procedure for payment of monetary support to servicemen of the Armed Forces of Ukraine and certain other persons, approved by the order of the Ministry of Defense of Ukraine dated 07.06.2018 No. 260. However, it is not uncommon for military units to unjustifiably refuse payments to which servicemen are entitled.
After discharge from military service, a serviceman has the right to receive such payments
- Money security;
- Compensation for the value of unclaimed material property (usually not paid to the mobilized);
- One-time cash assistance for those mobilized;
- Compensation for unused annual and additional vacations;
- One-time cash assistance;
- Cash assistance for recovery;
- Material assistance for solving social and household issues.
The composition of the monetary security to be paid includes:
- Monthly basic payments (official salary, salary according to military rank, seniority allowance);
- One-time additional payments (gratuities, additional remuneration for the period of martial law, combat and other types of assistance).
The list of payments and the composition of the financial support may vary depending on the specific case. Therefore, before the release, it is recommended to contact the legal service of the military unit or a lawyer to clarify all the details.
Money support for military personnel
Military servicemen are awarded monetary benefits upon dismissal:
The payment also includes the time of handing in cases and positions, unused vacation and sick leave period.
Financial compensation for unpaid tangible property
The material support of military personnel is regulated by the Order of the Ministry of Defense of Ukraine dated April 29, 2016 No. 232.
Monetary compensation for unreceived tangible property is provided in the following cases:
- exemption from military service;
- death (death) of a serviceman;
- transfer to other military formations or government bodies.
Compensation is paid based on the serviceman's report and the commander's order. A certificate of property value is issued by the property service based on the purchase price. In case of death, compensation is distributed among family members and dependents, if the application is submitted within three years after the death.
The mobilized can be released in civilian clothes or in what they used during the service. Unissued items of tangible property are not issued.
One-time monetary assistance to the mobilized
Military servicemen who were mobilized or called up for military service in a special period and are released, are provided with a one-time cash allowance in the amount of 4% of the monthly cash allowance for each full month of service, but not less than 25% of the monthly provision.
The benefit is paid for the period of service, starting from the day of enlistment, and does not include the previous period of service, except in cases where the servicemen did not receive compensation upon prior discharge.
Help is not provided in cases of dismissal due to official misconduct, deprivation of a military rank, a court conviction or an administrative offense related to corruption.
Financial compensation for unused annual and additional vacations
Military servicemen, with the exception of fixed-term service, who are released due to age, health, in connection with subordination to close relatives, or due to staff reduction or organizational changes, are granted financial compensation for all unused days of annual basic and additional leave for the year of dismissal, including female servicemen with children.
For servicemen called up during mobilization or a special period, compensation is also paid for unused days of annual basic leave upon release in the year when demobilization takes place or military service ends by decision of the President.
Compensation is calculated on the basis of official salary, military rank salary, seniority allowance and other additional payments, taking into account changes in financial support during the last position held.
Financial support to cover recovery costs
Servicemen who were discharged from military service and were entitled to financial assistance for rehabilitation, but did not receive it within a year, are paid the assistance based on the order of the commander of the military unit on exclusion from personnel. The amount of the benefit is determined based on the official salary, salary according to the military rank, seniority allowance and monthly additional types of financial support (not including bonuses), which the serviceman had on the day of signing the order.
For servicemen who are at the disposal of or released from their positions at the time of signing the order, the calculation of assistance includes the official salary according to the tariff category, the salary according to the military rank and monthly additional types of financial support (except for bonuses) taking into account the change in years of service and the norms of monetary support for the last full-time positions held.
