A combatant is a person who directly participated in the protection of the territorial integrity and sovereignty of the state during armed conflicts or war. In Ukraine, this status is granted to military personnel, law enforcement officers and other persons who performed combat tasks in the hostilities zone.
Question
Who can get UBD status?
Answer
UBD status can be obtained by servicemen of the Armed Forces of Ukraine (Ukraine), the National Guard, the Security Service of Ukraine (SBU), the Ministry of Internal Affairs (MIA), etc., who took part in combat operations, volunteers and participants in territorial defense, provided they perform combat tasks, as well as persons who provided direct support for military operations (for example, medical workers, sappers, signalmen, etc.).
Benefits provided by registration of the UBD:
The status of a participant in hostilities in Ukraine provides the following rights and benefits:
- Benefits for housing and communal services (75% discount).
- The right to free medical care.
- Priority right to receive a plot of land.
- Discounts for travel in transport.
- The possibility of receiving social benefits and cash assistance
To obtain this status, it is necessary to go through the procedure of submitting documents and obtain a UBD certificate.
Registration of the status of a participant in hostilities (UBD) in Ukraine requires a certain procedure and requires the submission of documents to the relevant authorities. The status of UBD provides social guarantees and benefits established by law.
The procedure for registration of the UBD status, how to issue UBD:
- Applying to a military unit or institution: A serviceman or other person applying for UBD status must apply to the command of his military unit or institution. The command or a responsible person must draw up a certificate about the person's participation in hostilities and collect other necessary documents.
- Collecting the necessary documents: the following documents should usually be prepared for registration of UBD: a certificate of direct participation in hostilities. It is issued by a military unit or other body that can confirm your participation in hostilities, a report or application for the granting of UBD status, a copy of a military ticket (pages confirming participation in hostilities and the period of service), a copy of your passport and identification code.
- Transfer of documents to the commission: documents are transferred to the commission, which deals with consideration of cases for the assignment of the status of UBD. Usually, such commissions function under regional military commissariats or other special bodies (for example, the Ministry of Internal Affairs, the State Border Guard Service, the SBU). The commission checks the documents, evaluates their compliance with the requirements and makes a decision.
- The commission's decision: after reviewing the documents, the commission makes a decision on granting or refusing to grant the status of the UBD. In the case of a positive decision, the person is issued a corresponding UBD certificate.
- Obtaining a UBD certificate: after receiving a positive decision, a person can apply to the relevant authority to obtain a UBD certificate. This certificate gives the right to benefits and social guarantees established by law.
Usually, the process of reviewing documents can last from several weeks to several months. In case of refusal to assign the status of UBD, a person has the right to appeal the commission's decision administratively or through a court.
Question
How many days do you need to be in the ATO to get an UBD?
Answer
In order to obtain the status of a combatant in Ukraine, there is no set minimum number of days of stay in the ATO/OOS zone.
An important criterion is the direct participation in the execution of combat missions and the performance of official duties in the area of the anti-terrorist operation (ATO) or the operation of the joint forces (OOS), and not how many days to be in the ato to get udb.
Basic requirements for getting udb:
participation in hostilities or performance of official duties in the area of anti-terrorist operation/unmanned aerial vehicle operation;
the presence of relevant documents confirming the presence in the combat zone, the performance of tasks, orders or orders of the command (for example, combat orders, extracts from orders, etc.);
confirmation of the facts of the person's stay and activity in the area where the anti-terrorist operation/restriction is conducted.
According to these requirements, even a short-term participation in hostilities can be the basis for getting the status of udb, if it is confirmed by the relevant documents.
