Legal assistance in obtaining deferment from mobilization — from consultation to court decision
In 2024, a client — a citizen of Ukraine — contacted me after the Territorial Recruitment and Social Support Center (TRSSC) denied his request for a deferment from mobilization, despite the fact that he was caring for his mother, who required constant external assistance. The goal was to challenge the unlawful denial and achieve a legal deferment.
I joined the case at the stage when the client had already received an official refusal. The military authority justified its decision by the absence of a document that is not even required by current legislation. I conducted a legal assessment of the situation, gathered evidence, prepared a lawsuit to the administrative court, and provided legal support during the hearing.
What steps help obtain a deferment from mobilization?
- Consultation and document collection. Client documents are analyzed, family status and health of the dependent clarified, medical conclusions, MSEC certificates, and proof of actual care are collected.
- Submitting an application to TRSSC. A full document package is prepared with a reference to Article 23 of the Law of Ukraine “On Mobilization Preparation and Mobilization.”
- Appealing the denial. If TRSSC refuses, a lawsuit is prepared for the district administrative court with appropriate legal arguments and evidence.
- Client representation in court. Presenting the client's case, proving the unlawfulness of the denial, and analyzing relevant court practice.
- Obtaining a court decision and enforcing it. The court recognizes the denial as unlawful and obliges TRSSC to grant the deferment. Control of the enforcement process follows.
Case study
Situation: The client was denied a deferment despite providing constant care to his elderly mother with certified Group I disability.
Actions taken:
- Prepared an application for deferment with medical documents and care certificates;
- Received an official refusal citing absence of a "required" certificate not mandated by law;
- Filed an administrative lawsuit to the district court to declare TRSSC’s actions unlawful;
- Fully represented the client in court, submitted additional evidence and explanations;
- Obtained a court decision satisfying the claim and declaring the denial unlawful;
- Based on the decision, a legal deferment from mobilization was granted.
Result: The client legally received a deferment from mobilization, as he was providing constant care to his disabled mother (Group I), supported by medical certificates and the court decision.
