Legal support in defending a fair division of marital property — from initial claim to successful appeal
A client approached me after his ex-wife filed a lawsuit regarding the division of jointly acquired property during their marriage. The client did not dispute the method of division proposed in the claim but disagreed with the calculation of each party’s share. He believed that the proposed split was unfair and did not reflect their real contributions.
The case had already passed the trial court stage, and the client sought assistance at the appellate level to restore fairness and protect his lawful rights. It was necessary to thoroughly review the case materials, analyze the legal arguments made in the first instance, and prepare a compelling appeal. This involved a careful assessment of financial contributions, household investments, and other relevant evidence.
What steps were taken to protect the client’s property rights?
- Initial consultation and case analysis. I studied the court’s decision from the first instance, reviewed the claim and materials, and identified violations and grounds for appeal.
- Preparation of the appeal. I drafted and filed a substantiated appellate complaint, arguing why the share calculation violated legal and factual fairness.
- Collection of additional documents. I helped gather evidence showing the actual contributions of both spouses, including proof of investments, income, and personal assets.
- Representation in the appellate court. I personally defended the client’s position during court hearings, presented detailed arguments, and responded to the opponent’s claims.
- Receiving a favorable decision. As a result, the appellate court granted the appeal and revised the division to reflect a fairer distribution.
