I' m a lawyer in civil, tax, family cases
Economic instability, martial law, political dissonance, mass outflow of specialists – led to a total shortage of qualified personnel in the country.
Almost every second citizen at least once in his life went through an interview and competitive selection for a position. However, during or after the interview, many people were disappointed and asked the question: "Would I have chosen this particular position or responded to this vacancy?" These questions are unique and future employees ask them for a reason.
After going through more than one round of interviews, disappointment sets in precisely because the employer tries to build a dialogue from the very first communication in such a way that the candidate feels uncomfortable.
When posting a vacancy, the employer can also knowingly already put forward discriminatory demands such as:
- having a higher education diploma from a specific university listed on the list. This is a completely incorrect requirement and immediately discredits all other future candidates who have a diploma of higher education and qualifications from a university that was not included in the employer's "TOP list";
- age requirements: no younger and no older than the age limit.
- gender requirements. When the employer immediately indicates that he chooses only women or only men for a specific position.
And now let's note what exactly puts the stage of the interview in a dead end:
- discriminatory issues: political views, attitude to religion, questions about age, what financial reward was received at the previous place of work, passing a polygraph test, if it is not a special state structure and other;
- gender inequality: questions about planning maternity leave, planning marriage, planning about children, etc.
If the employer puts forward exactly such requirements and builds the interview in such a format, then you should think about the need to cooperate with such an employer.
Now let's talk, when you have already passed the interview stage, your candidacy has been selected for future cooperation and you have already received the long-awaited job offer.
However, there are cases when the employer requires a number of requirements from the employee before the conclusion of the employment contract. For example, passing a medical examination with providing the results of medical examinations and the results of certain medical tests. However, in such cases, the specified requirements of the employer have no legal basis and are not supported by any law.
It is worth noting that the results of medical research and the results of tests are a medical secret that concerns only you and the doctor, no third party has the right to know and interfere with your state of health.
If the employer still threatens not to conclude an employment contract with you and refuses to hire you, you will need the services of a lawyer who will help you develop a legal analysis of the situation and choose a defense strategy.
It should be noted that every citizen has the right to appeal an illegal decision in court. The next stage with which your lawyer will work is the legal process regarding the illegal refusal to accept employment.
