Accompanying a person with a Group II disability abroad: who has the right and what documents will be needed?
To avoid misunderstandings when crossing the border, you need to know who exactly can accompany people with disabilities of group II, and what documents are needed to travel abroad with a person with a disability - read in the following material.
During martial law, the departure of militarily liable men aged 18 to 60 years abroad is restricted. To cross the border have the right to certain categories of persons. Currently, such a right is granted to persons who have a spouse with a disability of group I, II, III or parents or parents of the wife with a disability of group I and II. Escorting a person with a disability outside of Ukraine may be carried out by:
- persons who are related to the person with a disability (spouses, children may accompany their parents or vice versa);
- a legal or physical person who is permanently caring for a person with disabilities (if there are supporting documents);
- a representative of an organization that carries out social work to care for people with disabilities. Accompanying a person with a disability of group II: how to go abroad According to the Cabinet of Ministers of Ukraine Decree No. 57 of January 27, 1995, during a state of war, those citizens of Ukraine who permanently care for persons with disabilities of groups I and II, accompany persons with disabilities of group II, children with disabilities of group II and persons in need of constant care are entitled to cross the state border. According to the rules, it is possible to cross the border through the checkpoint only when accompanied by a person with a disability. That is, the mere fact of having a person with a disability does not entitle a person subject to military service to cross the border independently. It is possible to cross the checkpoint independently without a person with a disability only if such a person is already abroad. To do this, the border guard officer must be provided with a certificate that the person with a disability is on consular registration in another country. Please note: the accompanying persons must return to Ukraine no later than the person accompanied by them. If a person with a disability returns from abroad independently - it will be considered a violation. What documents will be needed to travel abroad with a person with a disability of group II For crossing the border it is necessary to provide a full package of documents, the list of which depends on who is accompanying and accompanying. Accompanying a wife with a disability To accompany a spouse with a disability at the border can be her official husband in the presence of documents confirming the disability and family ties:
- MSEC certificate on disability of the II group;
- marriage certificate;
- pension certificate. Accompanied by own parents or parents of the wife
To cross the border accompanied by your own parents or wife's parents, you must have the following documents:
- documents confirming family ties and cohabitation - extract from the demographic register on registration at the same address, birth certificate, marriage certificate;
- MSEC certificate of disability of group ІІ;
- pension certificate;
- LCC certificate on the need for permanent extraneous care for a person with a disability;
- act of establishment of permanent extraneous care for a person. Accompaniment of children with disabilities of group II group The mother or father, guardian, custodian, foster parents, foster parents may accompany children with disabilities when traveling outside Ukraine. An adult brother, sister, grandmother, grandfather, stepmother or stepfather may also accompany the child, given that they belong to the list of categories of persons exempted from military service and mobilization. This is possible if they have appropriate supporting documents and documents confirming family ties.
To travel outside Ukraine, accompanying children with disabilities, one must:
1. Documents confirming kinship ties (in the case of being accompanied by the father or mother);
2. Documents confirming the relevant powers of the person accompanying the child with a disability - in case of being accompanied by a guardian, custodian, foster parents, one or both foster parents). The above documents may be submitted either in original or as a notarized copy. Persons may be refused to cross the border if the full package of documents has not been provided. Peculiarities of accompanying a person with disability group II abroad Upon arrival of the person with disability and the accompanying person to the place of temporary stay outside of Ukraine, it is necessary within one working day to apply to the consular office of Ukraine in the state of stay to take persons with disabilities on consular registration.
Within one working day the consular office is obliged to inform the Ministry of Social Policy and the National Social Service through the Ministry of Foreign Affairs about taking a person with a disability into
consular registration.
To travel abroad, it is necessary to know the rules of traveling abroad and prepare the necessary documents for crossing the legalization, obtaining residence permit, study the rules of crossing the border to Apostille and the existing ban on employment permit.
