The procedure for conducting a medical and social examination to establish a disability group in Ukraine involves issuing a referral for an examination by health care institutions. This referral is issued on the basis of medical documents and other information confirming the patient's persistent impairment of body functions caused by diseases, injuries or birth defects that have led to limitations in the ability to perform vital activities.
This procedure is aimed at objectively establishing the degree of limitation of functions and determining the disability group for the purpose of further providing social benefits and assistance to persons with disabilities. Resolution of the Cabinet of Ministers of Ukraine No. 390 stipulates that the validity period of disability is automatically extended for the period of martial law, i.e. a re-examination to confirm disability can indeed be postponed until the end of martial law and within 6 months after its termination or cancellation.
This means that persons with disabilities who have already passed a medico-social examination and have an established disability and an individual rehabilitation program will not need to be re-examined during martial law and up to the sixth month after the termination or cancellation of martial law. Their rights and status remain unchanged during this period. This applies to cases where it was not possible to conduct a medical and social examination due to restrictions related to martial law.
In the event that a medical and social examination was conducted on a person with a disability and a decision was made to change or not establish a disability or the percentage of incapacity for work, the medical and social examination and the medical advisory commission must inform the relevant public social protection bodies, such as the Pension Fund of Ukraine and the Social Insurance Fund of Ukraine, about this decision.
In the absence of information about the adoption of such a decision in the specified bodies, it is considered that the disability has been extended until the last day of the sixth month after the termination or cancellation of the period of martial law, if a re-examination has not been carried out earlier. This approach ensures the maintenance of disability status for persons subject to this legislation in the event of insufficient information or restrictions related to martial law.
