Foreigners may be in Ukraine for various reasons, such as tourism, study, work, meetings with family or friends, political asylum, humanitarian aid, etc. They can reside temporarily or permanently in Ukraine depending on their status and purpose of stay.
To obtain a permanent residence permit in Ukraine, a foreigner usually must follow the following steps:
Collection of necessary documentation: The foreigner must collect all necessary documentation to apply for a temporary residence permit. This documentation may include a passport, health insurance, evidence of financial stability, documents confirming purpose and residential address, and other documents in accordance with the specific requirements of the migration authorities.
Submitting an application to the migration service for a residence permit: After collecting the necessary documentation, the foreigner submits an application for a temporary residence permit to the relevant migration service or the State Migration Service of Ukraine.
Consideration of the application: After submitting the application, the migration service will review it and decide whether to grant or refuse a temporary residence permit.
Obtaining a permit: In case of a positive decision, the foreigner will receive a temporary permit to reside in Ukraine.
In accordance with the Resolution of the Cabinet of Ministers of Ukraine dated October 21, 2022.No. 1202 “Some issues of implementation of legislative acts in the field of migration under martial law”, it is established that.
To obtain a temporary residence permit in Ukraine, a foreigner usually must submit the following documentation:
Valid Foreigner's Passport Document: This can be a passport or other form of identification. If a foreigner simultaneously holds citizenship of several states or is a stateless person, he must provide the appropriate documents for each citizenship or status.
Identity document of the legal representative: In the case of submission of documents by a legal representative, it is necessary to provide a document confirming the authority of this person as a legal representative.
Translation into Ukrainian of a page of a foreigner’s passport document: All submitted documents must have a translation into Ukrainian. This translation must be certified in accordance with the procedure established by law.
Document confirming payment of the administrative fee: The foreigner must present a document confirming payment of the administrative fee for obtaining a residence permit.
A copy of the decision to grant immigration permission or in accordance with the category of foreigners and stateless persons: This is a document confirming the right of a foreigner to stay in Ukraine in accordance with the category to which he belongs.
This documentation is general, but can be expanded or modified depending on the situation and the requirements of the migration authorities. Obtaining permanent residence in ukraine,temporary or permanent residence permits, except those issued to citizens of the Russian Federation, and whose validity has expired or are subject to exchange after February 24, 2022, confirm the legal grounds for temporary or permanent residence in Ukraine and the right to enter Ukraine for the period of martial law and for 30 calendar days from the date of its termination or cancellation.
Foreigners or stateless persons, with the exception of people of the Russian Federation, must, in accordance with the procedure established by law, submit documents for the exchange of such certificates for temporary or permanent residence within 30 calendar days from the date of termination or lifting of martial law.
This resolution regulates the legal status of foreigners and stateless persons in the context of the current situation in Ukraine and ensures their rights and obligations in accordance with the law, obtaining a permanent residence permit in Ukraine.
