On April 25, 2024, the Verkhovna Rada of Ukraine voted for draft law No. 7731, amending Article 41 of the Labor Code of Ukraine regarding the dismissal of employees at enterprises of strategic importance and critical infrastructure facilities.
The term "collaborator" is used to denote a person who collaborates with an enemy or opponent of his state or nation. This may be a person who provides information, assistance, or support to an enemy agent or to a state waging war or hostilities against its own state.
Collaborators can be persons cooperating with an aggressor state or other entities that threaten national security or work for the interests of another state outside of their own. They can carry out various activities, including providing confidential information, facilitating hostile activities, espionage, etc.
Draft Law No. 7731, which was adopted by the Verkhovna Rada of Ukraine, has a significant and important impact on the protection of strategically important objects and infrastructure of Ukraine from unwanted influence and cooperation with the aggressor state.
The introduction of the concept of "rules of conduct at an enterprise, institution, organization" as an additional component of internal labor regulations is an important step to ensure safety and protection of state interests. These rules make it possible to control and regulate the behavior of employees at critical infrastructure facilities, as well as to establish appropriate requirements for the preservation of confidential information and the prevention of cooperation with persons having ties to the aggressor state.These measures will contribute to increasing the safety and security of strategic objects and critical infrastructure, as well as strengthening the national sovereignty of Ukraine.
The release of collaborators at enterprises of strategic importance for the economy and security of the state or critical infrastructure facilities is an important measure to ensure national security and protect the interests of the state.
The initiative to release collaborators can be implemented in accordance with the relevant legislation and regulations adopted by the legislative body. Usually, such measures are taken on the basis of an investigation and collection of evidence about the cooperation of a person with an aggressor state or other entities that endanger national security.
It is important that such measures are carried out in accordance with the principles of justice and legality, as well as with respect for human and workers' rights. Employees who are suspected of collaboration should have the opportunity to express their position and defend their rights by conducting an objective investigation and providing them with the right to legal protection.
All measures related to the dismissal of collaborators must be supported by appropriate documentation and carried out within the framework of clear procedures established by legislation and internal rules of the enterprise.
