This part of Article 146 of the Criminal Code is applied in the case when the illegal deprivation of liberty or kidnapping of a person is accompanied by serious circumstances that deepen the gravity of the crime and increase its social danger.
Illegal deprivation of liberty or abduction of a person is committed by an organized group, which indicates a planned and coordinated criminal activity, or when the actions lead to serious consequences, such as serious bodily harm or death of the victim.
