DEPARTURE ABROAD
The list of persons who have the right to travel abroad under martial law:
1. Persons with disabilities.
2. Persons who have a wife (husband) from among persons with disabilities and accompany such a wife (husband) to travel outside Ukraine.
3. Persons who have one of their parents or spouse's parents (husband) from among persons with disabilities of group I or II and accompany one of such parents to travel outside Ukraine.
4. Persons who provide permanent care for persons with disabilities of the I or II group and accompany such persons to travel outside Ukraine.
5. Parents, guardians, custodians, adoptive parents, foster parents who raise a child with a disability under the age of 18.
6. Parents who are dependent on an adult child who is a person with a disability of the I or II group.
7. Grandmothers, grandfathers, adult brothers, sisters, stepmothers, stepfathers who accompany children with disabilities to travel outside Ukraine, if they belong to the category of persons who are not subject to conscription for military service during mobilization.
8. Persons who need constant care - accompanied by one of the family members of the first degree of kinship.
9. Guardians of persons with disabilities, recognized by the court as incapable, who accompany such persons to travel outside Ukraine.
10. Persons with disabilities or other persons in need of constant care who live (stay) in facilities/institutions regardless of the form of ownership and subordination and receive social services from inpatient care, palliative care, supported living.
11.Children.
12. Military personnel, members of the defense forces and security forces in need of medical treatment.
13. Drivers, employees of railway transport enterprises.
14. Participants of sports competitions (athletes, coaches, sports judges and other specialists).
15. Crew members of marine vessels.
16. Officials of state bodies, local self-government bodies, state enterprises.
Documents that must be carried for crossing the state border:
1. Valid passport document.
2. Military registration documents with appropriate markings.
3. For seafarers: seafarer's identity card, certificate from an educational institution or confirmation from the Shipping Administration.
4. For departure to the EU using the internal passport of a citizen of Ukraine: it is possible for persons evacuating from areas of hostilities.
In certain cases of traveling abroad, the list of necessary documents should be clarified according to the current norms of regulatory legal acts or after receiving advice from a lawyer.
It is worth noting the changes made to the Rules for crossing the state border by citizens of Ukraine during martial law.
Resolution of the Cabinet of Ministers of Ukraine No. 1044 of September 10, 2022 amends the Rules for Crossing the State Border by Citizens of Ukraine. Here are the main theses that reflect the content of this resolution:
1. The right to cross the border is granted to persons with disabilities in the presence of relevant documents confirming their disability.
2. Accompanying persons with disabilities is allowed to family members who have documents confirming family ties and disability.3. Changes to disability groups: husbands can now accompany wives with any disability group, not just I or II.
4. Travel abroad to visit disabled relatives who are already abroad is allowed in the presence of relevant documents, including a certificate of stay in the consular register.
5. Documents for crossing the border, in certain cases, can be, among others, certificates of disability, documents confirming family ties and documents confirming cohabitation or care.
6. According to the Ukrainian legislation, persons with disabilities and their companions have the right to an extraordinary pass through the state border of Ukraine.
Persons with disabilities who go for treatment and have appropriate documents, as well as persons with disabilities of the 1st group and their companions, have the right to special border crossings no more than once a week in one direction.
7. Accompanying male citizens of Ukraine aged 18 to 60 are no longer limited in the number of border crossings to leave Ukraine. They can go abroad to people with disabilities, people who need constant care, children with disabilities or a certain list of diseases that they are caring for, if these people (children) are on the consular register.
