Do you need a TCC permit to travel abroad - legal nuances
With the entry into force of the updated Law of Ukraine "On Mobilization Training and Mobilization" on May 18, the number of questions regarding border crossing by men has also increased. Yes, in the Law itself there are certain changes regarding the procedure. In particular, part 6 of Article 22 of the aforementioned Law states that during the period of mobilization, men aged 18 to 60 are required to carry a military registration document and present it at the request of a representative of the State Border Service of Ukraine in the border zone controlled by the border district and at checkpoints across the state border of Ukraine.
I will note from experience that it is still required. Therefore, the exact advice that should be followed is to update and clarify your data in the TCC SP + enter the information about the deferment received in your military registration document. According to paragraph 20 of the Resolution of the CMU dated December 30, 2022 No. 1487 "On approval of the Procedure for the organization and maintenance of military records of conscripts, conscripts and reservists", such a military registration document can be a certificate of registration at a conscription station (for conscripts), a military ticket (for conscripts or reservists), temporary certificate of conscript (for conscripts).
How does everything happen in practice?
There is information that at the border they require a letter from the TCC and SP with their rectangular stamp. That is, you need a TCC certificate for traveling abroad. At the same time, we note that the TCC has the right to prepare such a letter for up to 30 calendar days. It is as if the VLK certificate, verified data in the TCC, electronic record in "Oberig" have no legal significance when crossing the border. If we compare this fact with the legislation, we can draw a certain conclusion - yes, we really need a letter from the TCC and the JV.
Regarding innovations - according to the new law, the VIN code must be present on the military registration document. This code must be presented at the request of representatives of the TCC certificate, the police and border guards. Therefore, conscripts who have permission to TCC permit for traveling abroad a military registration document with a VIN code. This code is read by border guards with special devices, which allows them to gain access to the electronic personal file of a conscript. This is like an element - permission of the TCC to travel abroad for men.
In fact, the list of necessary documents when traveling abroad for men depends on the type of basis.
• If we are talking about those removed from the military registration due to health, then in addition to the standard letter from the TCC and the military registration document, a certificate of disability or a decision of the MSEK on unfitness for military service is also required. It should be noted that men with limited fitness for service do not have the right to leave Ukraine during martial law.
• Regarding those who are temporarily unfit: travel abroad is available if, in addition to the standard ones (permit of the TCC), there is a certificate of disability or a conclusion of the military medical commission (MMC) confirming the status of temporary unfitness for military service for a period of up to 6 months.
• If we talk about men accompanying a person with a disability, a relevant doctor's opinion or a document approved by the medical advisory commission is required. Important: you can cross the border only accompanied by a sick person/person with a disability. If a man tries to cross the border without such a person, he will be refused entry.
