The Verkhovna Rada of Ukraine Adopted the Law on Dispute Resolution Regarding Critical Infrastructure Objects
The Verkhovna Rada of Ukraine adopted in the second reading and in its entirety the Law on Amendments to Article 8 of the Law of Ukraine "On Critical Infrastructure" (regarding the resolution of disputes concerning the state's ownership of critical infrastructure objects that are state-owned) (bill No. 8316). This was reported by the press service of the Parliament.
Right to Court Appeal
It is noted that the right to court appeal to protect rights and freedoms is not limited. This is an important aspect that ensures citizens and legal entities can protect their interests in the event of disputes concerning critical infrastructure objects. Additionally, the law provides clear definitions of the procedures to be followed when applying to the court, which enhances transparency and accessibility of justice.
Enforcement Proceedings
Enforcement proceedings are not suspended regarding obligations that arose after the date of the forcible expropriation of shares (stocks, participations) of critical infrastructure operators in favor of the state. This includes decisions on the payment of wages, severance pay, other payments (compensations) due to employees in connection with labor relations; on compensation for material (property) damage caused by injury, other harm to health or death of an individual; on the recovery of alimony; on the recovery of arrears of contributions to the funds of compulsory state social insurance and arrears of the single contribution to compulsory state social insurance. Forcible Expropriation of Property
"The legal regulation of certain aspects of forcible expropriation of property under the conditions of martial law has been improved, which will provide additional opportunities for the elimination of the consequences of emergencies at critical infrastructure objects," the statement reads. This also ensures more effective response to crisis situations and minimizes negative impact on vital infrastructure objects.
Management of Corporate Rights
It is envisaged that, by decision of the Cabinet of Ministers, the Ministry of Defense of Ukraine will manage corporate rights (stocks, shares) forcibly expropriated under martial law, in accordance with the legislation on the management of state property objects. This will allow effective control and management of important infrastructure objects under wartime conditions, which is critically important for national security.
