Verkhovna Rada Passed Bill No. 9092-3 on the Powers of Parking Inspectors During Martial Law

The Verkhovna Rada of Ukraine has adopted Bill No. 9092-3 "On Amendments to the Code of Ukraine on Administrative Offenses Regarding the Powers of Parking Inspectors in Ensuring Road Traffic Safety" as a basis. This bill was approved on May 21, 2024, to regulate the activities of parking inspectors under martial law conditions. This was reported by the press service of the Verkhovna Rada.

Purpose of the Bill

The main goal of the bill is to temporarily, during the period of martial law, deprive the executive committees (executive bodies) of village, settlement, and city councils, represented by parking inspectors, of the right to temporarily detain vehicles. At the same time, the relevant powers are transferred to the employees of the authorized units of the National Police.

Key Amendments to the Code of Ukraine on Administrative Offenses

Expansion of Grounds for Administrative Liability

The bill expands the list of grounds for parking inspectors to hold individuals administratively liable under part six of Article 122 and part six of Article 1521 of the Code of Ukraine on Administrative Offenses.

  • Part Six of Article 122: Stopping or parking vehicles in places marked by appropriate road signs or road markings, where stopping or parking is allowed only for vehicles driven by drivers with disabilities or drivers transporting persons with disabilities.

Clarification of Sanction Norms

The bill also clarifies the sanction norms of Articles 122 and 1521:

  • Article 122: Exceeding established speed limits, driving through a prohibitive traffic control signal, and violating other traffic rules.
  • Article 1521: Violating the rules of parking vehicles and the rules of equipping paid parking lots for vehicles.

Prohibition of Temporary Vehicle Detention

During the period of martial law in Ukraine or in specific areas where martial law has been imposed, parking inspectors are prohibited from temporarily detaining vehicles.

Impact of the Bill on Public Safety

The adoption of this bill aims to ensure the safety of drivers during air raid alerts. Under martial law conditions, drivers are often forced to quickly leave their vehicles to seek shelter, often violating stopping or parking rules.
