Verification of documents
It is worth distinguishing between the verification of documents and the delivery of a summons. Inspection of documents is possible without serving a summons.
Subjects of document verification
To check the military registration document together with the identity document (further documents), authorized: representatives of the TPC, police officers, representatives of the State Border Service.
However, not every representative of the TPC is authorized to check documents, but only the one authorized to serve summonses. And the right to serve summonses must be confirmed by the representative of the TPC by presenting the identity card of the person authorized to serve summonses.
Resolution of the Cabinet of Ministers No. 560 stipulates that authorized persons can check documents at the place of residence, place of work or study, in public places, public buildings and structures, places of mass gathering of people, at checkpoints (checkpoints).
Before checking the documents, the representative of the TPC must introduce himself, stating his surname, first name, patronymic, position and present a certificate confirming the authority to issue summonses. In addition to such a certificate, an identity document (passport, military ID, officer's license) is also presented.
A representative of the State Border Service or a police officer must also present themselves in accordance with the procedures of the National Police and the State Border Service.
Scope of inspection
During the verification of documents, the status of citizens regarding military duty is established, their personal data and military registration document data are checked, comparing them with the data of the Unified State Register of conscripts, "Oberig" conscripts and reservists (territorial recruitment and social support center).
In what cases will it be suggested to proceed to the TPC?
In the case of a violation by a citizen of the rules of military registration or the existence of a discrepancy between the data of actual documents and the accounting data of the state register, and the military accounting data of the Unified State Register, the senior officer of the notification group will offer to proceed to the TPC to perform the necessary actions: taking military registration, passing a medical examination, entering changes to personal data available in the register.
The proposal to proceed to the TPC is formalized by delivery of a summons
If a reservist or military conscript refuses to accept a summons from an authorized representative, an act of refusal to accept a summons is drawn up. This act is signed by at least two members of the notification group.
An act of refusal to accept a subpoena is announced to the citizen. This act is submitted to the head of the district (city) TPC in order to take measures to bring the violator to administrative responsibility. The act of refusal to accept the subpoena is registered in the district (city) TCC.
In case of refusal to proceed to the TCC, the police officer carries out administrative detention
If a citizen refuses to go to the district (city) TPC, a police officer who is a member of the alert group carries out administrative detention and delivers the citizen to this center in accordance with Articles 261 and 262 of the Code of Administrative Offenses.
A police officer who is part of the notification group has the right to carry out administrative detention even in case of refusal to receive a summons.
In addition to the possibility of detaining a person in case of refusal to prosecute to the TPC (which, according to the order, is not a requirement, but a "proposal"), the Order also establishes the consequences of refusing to receive a summons.
