License to export goods.
To obtain a license to export goods, natural persons or authorized representatives of subjects of foreign economic activity submit to the Ministry of Economy of Ukraine or the relevant regional and Kyiv city state administrations a payment order and an original bank certificate of payment of the state fee for the license. The license is granted by these authorized administrative-territorial units to registered subjects of foreign economic activity in the respective regions, if the total value of the goods under the contracts does not exceed 300,000 US dollars, if no quantitative restrictions (quotas) have been established for the import of individual goods. goods A license may be issued to natural persons engaged in entrepreneurial activities or managers of subjects of foreign economic activity upon presentation of an identity document. In addition, authorized representatives must provide an original power of attorney confirming their right to obtain a license, along with their own identification document.
The decision to refuse to issue a license can be made in the presence of the following circumstances: inconsistency of the submitted documents with the legislation of Ukraine; achievement of the established quota for the relevant goods; applying to the subject of foreign economic activity or its foreign counterpart a special sanction in the form of temporary suspension of foreign economic activity in accordance with Article 37 of the Law of Ukraine "On Foreign Economic Activity" (959-12); actions of the subject of foreign economic activity, which lead to the violation of international obligations assumed by Ukraine; implementation by the subject of foreign economic activity of activities that may induce the competent authorities of the importing country to apply anti-dumping and other protective measures regarding the export of Ukrainian products; violation of the legislation of Ukraine in the field of foreign economic activity by the subject of foreign economic activity or its foreign counterpart. Any decision on the refusal to issue a license can be appealed in accordance with the procedure established by the current legislation of Ukraine.
In Ukraine, the payment of the fee for issuing export (import) licenses is suspended until the termination or abolition of martial law, according to the resolution of the CMU dated March 10, 2022 No. 241. The administrative fee for obtaining a license is set at 780 hryvnias for non-automatic licensing and 220 hryvnias for automatic licensing .
Export of goods in Ukraine is subject to licensing, as specified in Article 16 of the Law on Foreign Economic Activity. This licensing may take the form of automatic or non-automatic licensing. When the automatic licensing regime is introduced, licenses must be issued within 10 working days from the moment of receiving the application and all the necessary documents that meet the necessary criteria. On the other hand, when the non-automatic licensing regime is in place, applications must be processed within 30 days from the date of receipt if they are processed in the order of receipt. If all applications are reviewed simultaneously, the review period shall not exceed 60 days from the end of the announced application period.
According to the current legislation of Ukraine, natural persons have the right to appeal the decision to refuse to issue a license in accordance with the established procedure.
