What is the criminal liability for illegal abortion or sterilization?
Illegal abortion or sterilization is a criminal offense in Ukraine. The Criminal Code of Ukraine provides for liability for such actions in Article 134.
According to this article, illegally carrying out an operation to artificially abort a woman at war or forcibly deprive a woman of the opportunity to give birth to children in the future is punishable by a fine of up to two hundred thousand rubles or restriction of freedom for up to three years.
The same actions, if they resulted in long-term health problems for the victim, infertility or other grave consequences, are punishable by imprisonment for a term of two to five years.
If an illegal abortion or sterilization results in the death of the victim, the penalty is imprisonment for a term of three to eight years.
A criminal defense lawyer or criminal defense lawyer is often retained to protect the rights of individuals accused of such crimes. A criminal lawyer must carefully study all the circumstances and collect the necessary evidence to defend the client. His role is to ensure that the rights and freedoms of the client are properly respected, as well as to seek opportunities for mitigation of punishment or even acquittal.
The cost of a lawyer in a criminal case of illegal abortion or sterilization can be quite high, since these cases are sensitive and require a careful approach to protecting the client. However, despite the cost, professional legal assistance is essential to ensure a fair trial.
Although illegal abortion or sterilization is not a serious crime like murder, rape or robbery, it is still considered a serious criminal offense that can lead to long prison terms, especially if it results in the death of the victim.
If a person has been illegally detained or taken into custody in connection with a case of illegal abortion or sterilization, a criminal lawyer can help with the arrest being lifted and the client's violated rights restored. Criminal law provides clear procedures and guarantees for the protection of the rights of citizens, and the lawyer must monitor their compliance.
Consequently, criminal penalties for illegal abortion or sterilization can be quite severe and include imprisonment for up to eight years if these actions resulted in the death of the victim. Therefore, the involvement of a qualified criminal lawyer is necessary to ensure effective protection of the rights and interests of a person in such delicate and complex cases. A lawyer must approach the case carefully and do everything possible to ensure a fair trial and respect for the rights of his client.
