Penalties for failure to provide data to the TCC: can they confiscate property from those who are abroad
In the conditions of martial law in Ukraine, the issue of updating information in the Territorial Centers of Recruitment and Social Support (TCC) is becoming extremely urgent. According to the new requirements, citizens who have gone abroad are also obliged to report changes in their data in a timely manner. Violations of this obligation are subject to fines, which causes concern among Ukrainians living outside the country. Lawyer and founder of the Prikhodko&Partners legal company Andriy Prykhodko told Focus in more detail about this.
Lawyer Andrii Prykhodko warned that Ukrainians who have gone abroad may not even be aware of the imposed fines. Meanwhile, failure to pay such fines can lead to their increase and serious consequences.
Ukrainian citizens may be subject to administrative fines for failure to provide or untimely update of data in the TCC. However, the most important issue remains the possibility of property confiscation for such violations. According to current legislation, sanctions for failure to provide information are limited to fines and do not include direct confiscation of property.
General mobilization: how Ukrainians will be fined abroad
The ruling on the fine can be appealed, but only 10 days are allotted for this. If the fine is not paid on time, the TCC will turn to the enforcement service, and the amount of the fine will be doubled. In case of further non-payment, the executive service has the right to block the accounts.
Prykhodko emphasized that "In such cases, only Ukrainian accounts are blocked, while there is no access to cards of foreign banks."
In case of violation of the rules of military registration and ignoring the fine, the steps are as follows:
- TCC imposes a resolution;
- the military commissariat applies to the executive service;
- executive service blocks accounts;
- funds or property are collected from the violator.
If citizens who are abroad do not fulfill their obligation to update their data, it may make it difficult for them to return to Ukraine. However, it is important to note that specific coercive measures, in particular confiscation of property, can be applied only after a corresponding court decision. Ukrainians who have not updated their military registration data within 60 days after increased mobilization will be fined. Even staying abroad does not exempt from responsibility.
General mobilization: can property be taken abroad
The fine for failure to provide data to the TCC does not exceed 60,000 hryvnias, so confiscation of real estate or transport is not provided for. The state can seize only the property that is in Ukraine and corresponds to the amount of the debt.
"All funds are collected exclusively from Ukrainian accounts, and all property - only on the territory of Ukraine. There are no mechanisms for seizing property abroad or funds from foreign banks. That is, only property in Ukraine is subject to inspection, and it is this that will be seized," explained the lawyer. Therefore, Ukrainians temporarily living abroad should carefully monitor changes in legislative requirements and timely update their data in the TCC in order to avoid possible fines and other legal consequences.
